Sir,
I have laid before the Lords Commissioners of
His Majesty's Treasury Mr. Ellis' letter of the 3rd
June, 1930 (72765/30) on the subject of the Hong Kong
Companies Amendment Ordinance 1929.
In reply I am to request you to inform
Lord Passfield that Treasury Letter of the 30th April,
1930, was written on the understanding that the Hong
Kong Company law contained a provision corresponding to
Section 36(b) of the Companies Consolidation Act, 1908
(as does the Straits Settlement Companies Ordinance
No.13 of 1923, Section 39 (b)). As, however, it now
appears that there is no such provision in the Hong Kong
law and that shares held on the local registers are not
deemed to be situate in Hong Kong wherever the holder
was domiciled at the time of his death, there can of
course be no possibility of the misapprehension
mentioned in the last paragraph of that letter, and My
